These Terms & Conditions (“Terms”) govern your access to and use of MemoraStory (the “Service”) provided by MemoraStory LLC (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

Acceptance of Terms

If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Eligibility & Accounts

  • You must be at least 13 years old (or the age of digital consent in your region).
  • You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
  • Provide accurate information and keep it up to date.

User Content & Licenses

You retain ownership of content you submit, post, or display on the Service (“User Content”). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it solely to operate and improve the Service. You represent that you have all rights necessary to grant this license and that your content does not infringe any third-party rights.

Acceptable Use

Do not, and do not allow others to:

  • Violate any law or the rights of others (including privacy and IP rights).
  • Upload malicious code, spam, or content that is unlawful, hateful, or harassing.
  • Attempt to bypass security or interfere with Service operation.
  • Misrepresent your identity or affiliation.

Payments & Upgrades

Certain features may require payment (e.g., premium or lifetime options). Prices and features may change. Taxes may apply. If a subscription is offered, it will renew unless canceled in accordance with the provided cancellation process. Refunds are handled per our posted policy or as required by law.

Refund Policy

We want you to be fully satisfied with your purchase. If you upgrade a memorial to a paid plan (such as Lifetime or Premium) and are not satisfied for any reason, you may request a full refund within 30 days of purchase.

Refunds are available only for purchases made directly through MemoraStory LLC using our official checkout process. To request a refund, please reach out via ourContact pagewith your order details.

After 30 days, all purchases are considered final and non-refundable. Refunds will be returned to the original payment method. This policy applies only to digital memorial services and does not cover any physical products or third-party services.

Intellectual Property

The Service, including software, branding, and content (excluding User Content), is owned by MemoraStory LLC or its licensors and protected by applicable intellectual property laws. No rights are granted except as expressly set forth in these Terms.

Privacy

Your use of the Service is subject to ourPrivacy Policy. Please review it to understand how we collect, use, and share information. Using the Service signifies your consent to our data practices as described there.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MemoraStory LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless MemoraStory LLC from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. Certain provisions survive termination (e.g., IP ownership, warranties disclaimer, limitations of liability).

Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice (e.g., by email or within the Service). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
